Terms of Service

1. Account and Staff Terms

• Eligibility: You must be an authorized representative of the retail or pharmacy business registering for the account.
• Security: You are responsible for maintaining the security of your admin account and password. BestPOSApp cannot and will not be liable for any loss or damage from your failure to comply with this security obligation.
• Staff Accountability: You are fully responsible for all activity that occurs under your account, including transactions and inventory modifications performed by your staff members through their multi-user accounts.

2. Subscriptions, Billing, and Payments

• Pricing Model: BestPOSApp operates on a fixed-tier subscription model (Growth, Professional) billed on a monthly or yearly cycle. A free Foundation plan is also available with limited features.
• Payment Processing: We utilize trusted third-party payment processors, such as Flutterwave, to facilitate secure transactions. By subscribing to a paid plan, you agree to their respective processing terms.
• Auto-Renewal: Subscriptions automatically renew at the end of each billing cycle unless canceled prior to the renewal date.
• Refunds: Payments are strictly non-refundable except as explicitly outlined in our Refund and Cancellation Policy.

3. Service Availability and Offline Architecture

• Offline Mode: BestPOSApp is built with an offline-first architecture, allowing you to process sales without an active internet connection. However, you are responsible for ensuring your devices periodically connect to the internet to sync local transaction data to our secure cloud servers.
• Device Agnostic: The service is provided via web browser and is hardware-agnostic. We are not liable for the failure, malfunction, or incompatibility of your local hardware (computers, barcode scanners, receipt printers, or mobile devices).

4. Data Ownership and Privacy

• Your Data: You retain all rights and ownership to the business data uploaded to the platform (including inventory, sales history, and customer lists). You grant us a license to host, process, and securely store this data to provide the service to you.
• Privacy: Our collection and use of information are governed by our Privacy Policy.

5. Third-Party Integrations

Our platform includes third-party integrations, such as Tawk.to for customer support and an embedded social widget from MindViewers (mindviewers.com/embed). We are not responsible for the availability of external services. Note that the MindViewers widget can be disabled by merchants subscribed to our Professional plan.

6. Acceptable Use

You agree not to use the BestPOSApp platform to violate any local, state, national, or international laws, including the sale of illegal, prohibited, or unauthorized goods. You must not modify, adapt, or hack the Service, nor transmit worms, viruses, or any code of a destructive nature.

7. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Tormuto Information Technologies be liable for any direct, indirect, incidental, special, consequential, or exemplary damages. This includes, but is not limited to, damages for loss of profits, inventory discrepancies, data loss, or business interruption resulting from the use or inability to use the service.
